Brian M. Marriott was recently successful in a jury trial in Philadelphia County. Mr. Marriott’s client (a large automobile dealership) and its national manufacturer were sued under theories of Lemon Law, breach of warranties, misrepresentation, New Motor Vehicle Damage Disclosure Act, and under the Magnuson-Moss Warranty Act. At trial, Mr. Marriott represented both the dealership and the manufacturer. After plaintiff rested her case, Mr. Marriott made four distinct Motions for Non-suit, arguing that the plaintiff had failed to put sufficient evidence before the jury that would warrant a verdict in plaintiff’s favor on any of her eight alleged counts. The judge agreed, dismissing all eight counts of plaintiff’s Complaint. The case in its entirety was therefore dismissed.
